Terms and Conditions
We want to ensure that you have an easy and successful online experience, however, if you have any questions on how to use this website or how to make a reservation, please feel free to send an e-mail or use our contact form.
All products are "live" offers and are updated at least monthly. For your peace of mind, we make sure that your booking is fully confirmed before you receive a final confirmation and before your credit card is charged. We want to help you enjoy your trip.
Participant Guidelines
1.- All Vallarta Water Adventures.com tours have been closely examined and rated to be the best available. The tours are
intended to provide fun, excitement, rest and relaxation for all family members
so really no experience is necessary, however, please keep in mind that safety comes first, particularly with
what's commonly known now as action or extreme tours, therefore, these action tours are NOT
recommended for pregnant women, those suffering back pain or the elderly.
2.- ATV's are semi-automatic, very easy to drive, even for beginners. Buggies are standard, 4-gear,
old-fashioned off-road VW Beetles. Horses are fully automatic (couple carrots needed to start!)
3.- Guests must arrive to the scheduled tour or activity at least 20 minutes prior to departure.
4.- ATV and VW Buggy drivers must be 16 and older, however, children ages 5 to 8 are allowed to ride free
with an adult. Children 8 to 16 pay for the second seat.
5.- ATV and VW Buggy drivers must provide proper I.D. upon registration for tour, as well as a current
Driver's License.
6.- ATV and VW Buggy drivers must also provide a valid Credit Card, which will be charged ONLY in case you
wreck the ATV or car (but you won't, right?).
7.- ATV and VW Buggy drivers must follow leader and keep their place along the line at all times without
passing. Breaking this rule will likely result in disqualification from the tour.
Booking and Confirmation
1.- Once you have selected the tours and activities you would like to enjoy, you must complete the details on the website, including the payment details.
2.- Every booking is fully confirmed with our suppliers before you receive a final confirmation from us and before your credit card is charged.
3.- We will send you two emails within 24 hours, if not immediately:
- The First email will state "Your VWA.com Reservation"; and it will include a summary of your reservation to be reviewed and then processed.
- The Second email will state "VWA.com Payment Request" and provides a 100% secure way to pay for your tour and for you to get Final Confirmation Code for the booking and it will serve as your Reservation Voucher to redeem your service. If we cannot confirm the booking, then the second email will say that the booking cannot be confirmed as booked, however we'll be glad to present you with some other alternatives or options. If we are unable to process your booking at your entire satisfaction, we shall not process any payment.
Note: a VWA.com "Welcome" email is also sent to new members.
4.- If you have not received your "Your VWA.com"; email within 24 hours of booking, please check your "Bulk Mail" or "Junk Mail" folders of your email system. You may also login to your account to double-check your order(s). If you still do not see your confirmation, please contact us.
5.- The Reservation Voucher is a binding contract between you the Customer and Vallarta Water Adventures.com, therefore it will come into force at the time we send out your Confirmation email, and until then we shall be under no liability to you whatsoever.
6.- The name of the leading passenger should be correctly entered at the time of booking and that is how it will appear on the Reservation Voucher. Therefore the voucher is not transferable.
7.- An order can include two or more different tour bookings. This website will not stop you from making incorrect orders such as booking two tours in different places for the same dates, or booking a tour for one place and you showing vouchers in another. If you error in this kind of double booking, you are subject to our Cancellation Policy.
8.- It is essential that you print the voucher and present it upon commencement of your activity or tour. Valid photo ID is required for the leading passenger and it must match the traveller's name as indicated on the Reservation Voucher as well as the supplier's records. Usually first and last names are sufficient.
9.- In all booking arrangements, the person making the booking shall be deemed to have accepted the booking conditions on behalf of the persons included in the booking. The Reservation Voucher is a contract that will be governed by and subject to these Terms and Conditions. No variation to the Terms and Conditions shall be of any effect unless made in writing and/or posted in this website by and with the authority of Vallarta Water Adventures.com.
10.- Vallarta Water Adventures.com will provide Customers with one Reservation Voucher for each different activity and/or tour and it will be provided by date and booking id number.
Cancellation
1.- All reservations cancelled are subject to a cancellation fee regardless of the date on which these activities were booked. Please look at the cancellation fee as follows:
- Cancellations received 15 days or more prior to tour date, get 85% refund.
- Cancellations received from 14 to 5 days prior, get 50% refund.
- Cancellations received within 4 days prior are Non-Refundable.
2.- No refunds will be given if the following events occur:
- Cancellation notice is received within 4 days prior to tour date.
- Failing to show up on time for your tour.
- Failing to provide e-mail print including confirmation code.
- Failing to provide proper I.D. confirming that the person booked is the person taking the tour, unless we are previously instructed otherwise.
- For ATV's and VW Buggy tours, failing to provide a valid Driver's License and credit card upon registration. In case you don't want to use a credit card, usually a cash deposit will be necessary.
- For ATV's and VW Buggy tours, if you are disqualified from the tour.
3.- It's essential that you notify us ASAP of your need to cancel at: info@vallartawateradventures.com.
4.- Tours cancelled due to reasons beyond our control (such as bad weather), are still subject to a 15% processing fee regardless.
Payment
1.- Credit cards accepted through PayPal: Mastercard, Visa and American Express.
2.- Full payment by credit card is required to get a reservation confirmation.
3.- Payment will be listed as VWA.com on your credit card statement.
4.- VWA.com does NOT charge a service fee for processing credit card payments.
5.- In the event we are unable to confirm your booking we shall not process any payment.
Prices
1.- Prices listed are per person in United States Dollars (USD), unless otherwise specified. Prices are based on the local tariffs at the time of quoting converted at the prevailing foreign exchange rate. Price quotations are subject to change without notice until a booking has been confirmed.
2.- Prices do NOT include any applicable local tax, security, port charges, park fees, customs fees, immigration fees, agricultural, passenger facility charges and/or local transportation fees.
3.- Prices do NOT include tips/gratuities to tour directors, drivers and/or local guides; passports; visa; baggage and personal insurance; beverages and food not listed as included in the tour description (these items may be billed to you before ending the tour or leaving the restaurant/mall); and any other items of a personal nature.
Responsibility Disclaimer
1.- You will be able to find the name and address of the tour or activity supplier on your Reservation Voucher. The Reservation Voucher also governs the relationship between you and the supplier. This means that outside these Terms and Conditions, ultimately any decisions on cancellation, exchanges and refunds will belong to the supplier in conjunction with Vallarta Water Adventures.com.
2.- Agreeing Customers acknowledge by their acceptance that, Vallarta Water Adventures.com, its partners, agents and suppliers, in making arrangements for tours, activities, transportation or any service listed or described herein, shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any hotel, carrier or other company or person providing services included or not included in the tours. Further, Vallarta Water Adventures.com, its partners, agents and suppliers accept no responsibility for any sickness, pilferage, labour disputes, machinery breakdown, government restrains, acts of war and terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond their control. Vallarta Water Adventures.com reserves the right to cancel, change or substitute any service and to decline, to accept or retain any tour members at any time for any reason including, without limitation, insufficient number of participants. The sole responsibility of any tour supplier used in any reservation or service is limited to that set out in the tour description contract evidenced by the Reservation Voucher. Any tour supplier shall not be liable for any inconvenience, loss or damage, injury, accident, delay or irregularity which may be occasioned by reason of defect or through the acts or omissions of any person or company performing or rendering the services, responsible for any changes or increased costs incurred by passengers as a result of the cancellation of services due to be provided by its agents or suppliers for any reason including, without limitation, insufficient number of participants. All tour vouchers issued are subject to these Terms and Conditions specified by Vallarta Water Adventures.com, its agents and suppliers.
3.- Vallarta Water Adventures.com reserves the right to update these Terms and Conditions at any time without prior notice.
Privacy Policy
About Personal Information
We understand people's concern when it comes to personal information provided over the internet. Rest assured, we will NOT disclose, rent, sell or otherwise divulge any of that information. We have developed our reservations engine with a secure encrypted connection that you can trust. We may use your e-mail address to occassionally send you promotions that you might be interested in, however, you can always opt-out the delivery list by clicking a link within that e-mail to stop receiving such promotions.
Why we ask where you are staying
We know you might find this intrusive but there's a good reason why: sometimes is critical for us to be
able to get a hold of you before and after you have taken any of our tours. For
example: sometimes during the summer months it rains so heavily that trails
have to be reopened or repaired by local authorities and this may take long
enough to force us to reschedule your tour for a few hours or even a full day.
And we will need to make you aware because we would much rather take you out on a tour
well done the next day than to just make it shorter and not give you your
money's worth. This of course, provided you are able to reschedule.
Another reason is that more often than not, unfortunately, people would forget
belongings of all kind without having the slightest idea of where. And again,
if we find stuff, we want to return it. We know you might have access to the internet but
what if you don't? And you can guess we're not going to call your mobile because
it would cost us a fortune. So please, help us serve you better and let us know
where to find you. We won't tell anyone.
